Terms of Service

You must be at least 18 years old (or the age of majority where you live) to create an account, book services, or make purchases. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your account. Notify us immediately at sales@jotechracing.com if you suspect unauthorized use.

We may refuse, suspend, or terminate accounts that violate these Terms, that we reasonably believe are fraudulent, or that pose a risk to the Platform or other users.

The Platform includes, without limitation:

• Public showcases of customer builds, dyno results, records, and events;
• Member profiles, the owners club, and the owner garage portal (service history, maintenance reminders, build documentation);
• Requests and bookings for shop services such as dyno sessions, tuning, and installation work;
• Purchases and deposits for parts, packages, memberships, event registrations, and merchandise;
• Vehicle listings and marketplace features for Jotech-built or Jotech-certified vehicles;
• Community features such as photos, videos, comments, and leaderboards.

We may add, change, or discontinue features at any time. Some features require an account or an active paid membership.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Platform for your own non-commercial use. This license does not include any right to:

• copy, modify, distribute, sell, or lease any part of the Platform;
• reverse engineer, decompile, or attempt to extract source code;
• scrape, harvest, or bulk-download content or data, including by automated means;
• use the Platform to build a competing product or service.

All rights not expressly granted are reserved by Jotech Motorsports and its licensors.

Prices are listed in U.S. dollars and, unless stated otherwise, exclude taxes, shipping, and installation. Applicable sales tax is added at checkout or on the invoice. We may correct pricing errors, including after an order is placed, in which case you may cancel for a full refund of the affected item.

Payments are processed by third-party payment processors (for example, Intuit/QuickBooks Payments). We do not store full payment card numbers on our systems. By submitting payment information you authorize us and our processors to charge the amounts you approve, including recurring membership fees where you enroll in a recurring plan.

• Memberships: recurring fees bill at the stated interval until you cancel. You can cancel any time from your account or by contacting us; cancellation stops future billing but does not refund the current period unless required by law.
• Estimates and invoices: service work is billed per the written estimate or invoice you approve. Additional work requires your approval.
• Chargebacks: if you dispute a legitimate charge, we may suspend your account and any pending services while the dispute is resolved.

• Special-order parts: deposits for parts ordered specifically for your vehicle (including custom and overseas orders, which can take 30–60 days or more) are non-refundable once the order has been placed with the supplier, except where the parts cannot be delivered.
• Service & dyno bookings: reschedule or cancel at least 48 hours before your appointment. Later cancellations or no-shows may forfeit the booking deposit or incur a fee.
• Event registrations: refundable per the terms stated on the specific event page. Events may be rescheduled for weather or safety; your registration transfers to the new date, or a credit is issued.
• Merchandise: merch sold through our store partners is governed by the return policy stated at the point of sale.
• Labor: completed labor is non-refundable. Concerns about workmanship should be reported promptly so we can inspect and remedy.

Nothing in this section limits rights you may have under applicable consumer law.

Read this section carefully. It matters. Much of what we sell and install is designed to increase vehicle performance beyond factory specification.

• Emissions & street legality: certain performance parts and calibrations are intended solely for closed-course competition and off-highway use, and may not be legal for use on public roads in your jurisdiction (including under U.S. EPA regulations and state laws such as those enforced by CARB). You are solely responsible for confirming legality where the vehicle is registered and operated.
• Factory warranty: aftermarket parts and tuning may void or limit your vehicle manufacturer’s warranty. That risk is yours.
• Performance figures: horsepower, torque, ET, and other figures shown on the Platform are measured results for specific vehicles under specific conditions. They are not a promise that your vehicle will achieve the same results.
• Increased stress: modified vehicles experience increased mechanical stress. Components can fail. You accept the inherent risks of operating a modified vehicle, and of dyno testing and motorsports activities, which are dangerous by nature.
• Events: participation in track days, roll racing, and similar events may require you to sign separate liability waivers and to hold appropriate licenses, insurance, and safety equipment.

Vehicle listings, build pedigrees, dyno slips, and pre-purchase inspection (PPI) reports on the Platform are provided for information only. Inspections reflect the condition of a vehicle at the time of inspection and are not a warranty or guarantee of future condition or performance.

Vehicle sales, title transfer, and registration services are handled by a separate licensed dealer entity affiliated with Jotech, or directly between buyer and seller. Unless expressly stated in a signed purchase agreement, Jotech Motorsports is not a party to a vehicle sale between third parties and is not responsible for the accuracy of seller-provided information. All vehicle purchases should be verified independently.

You retain ownership of the photos, videos, comments, run data, and other content you submit (“Your Content”). By submitting it, you grant Jotech Motorsports a worldwide, royalty-free, non-exclusive, transferable license to host, store, reproduce, adapt (e.g., resize/crop), publish, publicly display, and distribute Your Content on the Platform and in Jotech marketing (including social media), for as long as your account exists and for a reasonable period after removal for backups and archives.

You represent that you own or have the rights to Your Content, and that it does not:

• infringe anyone’s intellectual property, privacy, or publicity rights;
• contain unlawful, defamatory, harassing, or obscene material;
• depict illegal street activity presented as such (illegal racing on public roads, etc.).

We may moderate, edit for display, or remove any content at our discretion. To report content that infringes your copyright, email sales@jotechracing.com with the details required by the DMCA (17 U.S.C. § 512).

• Don’t break the law or encourage others to;
• Don’t interfere with the Platform’s operation or security, probe, or test vulnerabilities without authorization;
• Don’t impersonate others or misrepresent an affiliation with Jotech;
• Don’t use the Platform to spam, phish, or distribute malware;
• Don’t access other users’ data without permission;
• Don’t use automated tools to scrape or bulk-collect Platform content or data.

The Platform, including its design, text, graphics, photography we produce, logos, trademarks (including “Jotech” and the Jotech logo), software, and data compilations, is owned by Jotech Motorsports or its licensors and protected by intellectual property laws. You may not use our trademarks or trade dress without our prior written permission.

The Platform integrates and links to third-party services, for example embedded Instagram, Facebook, and YouTube content, Google services, payment processing by Intuit/QuickBooks, and merchandise sold through external stores. Those services are governed by their own terms and privacy policies, and we are not responsible for them.

By creating an account or transacting with us, you consent to receive transactional emails (receipts, booking confirmations, service and maintenance notifications, account notices). With your consent where required, we may also send marketing communications. You can opt out at any time via the unsubscribe link or by contacting us. Opting out of marketing does not stop transactional messages.

THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Warranties applicable to specific parts or services, if any, are stated in the written estimate, invoice, or manufacturer documentation for that part or service, not in these Terms. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOTECH MOTORSPORTS AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR VEHICLE VALUE DIMINUTION, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH THE PLATFORM FOR THE TRANSACTION GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED BY LAW, AND DOES NOT APPLY TO IN-SHOP SERVICE WORK GOVERNED BY A SEPARATE SIGNED AGREEMENT.

You agree to defend, indemnify, and hold harmless Jotech Motorsports and its owners, employees, and agents from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Platform in violation of these Terms, your violation of law, or your operation of a modified vehicle.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at sales@jotechracing.com and give us 30 days to resolve the issue informally.

Any dispute that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Dallas County, Texas (or remotely by agreement). YOU AND JOTECH EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. Either party may instead bring an individual claim in small-claims court. You may opt out of this arbitration provision by emailing sales@jotechracing.com within 30 days of first accepting these Terms.

You may stop using the Platform and request account deletion at any time. We may suspend or terminate your access for violation of these Terms, suspected fraud, or legal necessity. Sections that by their nature should survive termination (including content licenses granted for published material, disclaimers, limitations of liability, and dispute resolution) survive.

We may update these Terms from time to time. Material changes will be announced on the Platform or by email, and the “Effective date” above will change. Continued use of the Platform after changes take effect constitutes acceptance. If you do not agree to updated Terms, stop using the Platform.
